Legal seminar on Chinese enterprises investment and financing in Oceania successfully held

On September 14, 2017, the Shanghai Listed Companies Association, Shanghai Equity Investment Association, Shanghai International Trade in Services Industry Association, Shanghai Academy of Social Sciences and Jin Mao Partners jointly organized the legal seminar on Chinese enterprises investment and financing in Oceania in Shanghai. Li Fei, Deputy Secretary-General of the Standing Committee of the National People's Congress, and Li Chang Dao, former director of the Shanghai Municipal People's Government, delivered speeches respectively. Zhou Han Min, vice chairman of the CPPCC Standing Committee, vice chairman of the Standing Committee of the CPPCC and vice chairman of the Shanghai Municipal People's Political Consultative Conference, delivered a keynote speech. Deputy director of Shanghai Municipal Commission of Commerce Shen Wei Hua, Deputy director of the Shanghai Academy of Social Sciences Zhou Wei, the CPC Shanghai Huangpu District Committee Standing Committee, Politics and Law Committee Secretary Lu Nan Ting, Shanghai Academy of Social Sciences Institute of Law Ye Bi Feng, Shanghai Listed Companies Association Secretary Qian Heng, Shanghai International Services Trade and Industry Association President and Dong Hao Lan Sheng Group President Chi Hong, Shanghai International Arbitration Center Deputy Director and Secretary General Ma Yi, 2016 Chinese Government Friendship Award winner Roche Diagnostics CEO Huang Bai Xing, Shanghai Municipal People's Government Counselor Xu Jing Lin, Shanghai State-owned Assets Supervision and Administration Commission Zhong Ke Wei, deputy director of Huang Pu District Bureau of Justice Yang Dong Yu, hundreds of Chinese and foreign entrepreneurs, financiers and lawyers have participated in legal seminars.

Li Fei, deputy secretary general of the Standing Committee of the National People's Congress, pointed out in his speech that the legal practitioners of the law and industry jointly organized a series of seminars on overseas investment and financing of Chinese enterprises and deepened exchanges and cooperation with market participants such as entrepreneurs and financiers, so as to provide intellectual support and the rule of law protection for "Belt and Road" Initiative and the relevant state departments for overseas investment and financing activities of the legislative recommendations, which has great practical significance, and worth promoting and perseverance.

Shen Weihua, deputy director of the Shanghai Municipal Commission of Commerce, stressed in his speech that legal practitioners shall pay more attention to the details of business activities and be good at spreading legal rules and legal culture among the "going out" enterprises. The CPC Shanghai Huangpu District Standing Committee, District Politics and Law Committee Secretary Lu Nan Ting on behalf of the district party secretary and mayor Gao Yun affirmed Jin Mao Partners for its establishment of the BRICS + Lawyers Service Alliance, which is the active response by legal profession and the lawyer community to national strategy and strengthening the cooperation between Chinese and foreign lawyers and entrepreneurs and financiers, and which is conducive to enhancing people-to-people bonds  amongst the BRIC countries and developing countries. President of the Shanghai International Service Trade Industry Association and President of the Dong Hao Lan Sheng Group, Mr. Chi Hong, encouraged the lawyer industry, which is an important component of trade in services, to actively cooperate with Chinese and foreign entrepreneurs, financiers and highly valued those legal experts making effort in legal research and service to overseas investment and financing by Chinese enterprises.

Zhou Han Min, Vice Chairman of the Shanghai Municipal People's Political Consultative Conference (CPPCC), has made a keynote speech on the legal issues during the “going-out” strategy by Chinese enterprises as well as the achievements gained by BRICS countries leaders in Xiamen Summit. Chairman of the Shanghai International Arbitration Center and Secretary General of the Shanghai International Arbitration Center, Ma Yi, Shanghai Head of the Shanghai International Arbitration Center. Australia's listed company 99 Unlimited Chief Financial Officer Chen Huan, Australia Securities President Xu Zhou, founding partner of Jin Mao Partners Jack Li, shared their thoughts and minds on the latest development of the Asia-Pacific dispute resolution agencies, Australia listed on the issue and China Venture Capital Investment and financing Legal risk prevention respectively. Participants pointed out that Oceania countries have significant influence amongst the world territory and the "Belt and Road" countries as well. In President Xi’s series of important speeches and the new ideas and new strategies of CPC Central Committee, the Chinese enterprises investing in Oceania countries is growing rapidly. However, in the process of going out, Chinese enterprises face a variety of legal risks, but a complete and efficient prevention mechanism is bound to be able to escort it. The experts have suggested that the "Overseas Investment Law", which regulates and directs overseas investment and financing activities of Chinese enterprises, will be issued as soon as possible. In the face of many legal risks, the state, industry associations and enterprises should become the three important participants in building a risk prevention mechanism for Chinese enterprises to invest in Oceania or abroad.

The initial release of the book " legal research on Mainland enterprises to invest and finance in Hong Kong, Macao and Taiwan", which is the starting work of the Chinese enterprises overseas investment and financing series was held in the seminar. Shanghai Academy of Social Sciences Legal education and research academic practice base, as well as the BRIC + lawyers service alliance, and " Law Research and Service Center Australia Station" and Jindao Partners Sydney Representative Office held the unveiling ceremony in the seminar. The BRICS + Lawyers Alliance aims to strengthen communication and cooperation between legal practitioners in emerging market countries such as BRIC countries and developing countries to build a community of legal services.

It is reported that Legal seminar on Chinese enterprises investment and financing in Oceania is another important legal seminar focusing on the legal issues and risk prevention for the going-out Chinese enterprises after the series Legal seminar of “Chinese enterprises investment and financing in Japan”, in May 2016; “in USA” in November 2016; “in Europe” in March 2017; and “in Asia” in May 2017.
