The 3rd IPBA Asia Pacific Arbitration Day was held in Kuala Lumpur
On September 25, 2017, the 3rd IPBA Asia Pacific Arbitration Day was held in Kuala Lumpur, capital of Malaysia. The symposium is organized by the Inter-Pacific Bar Association and the Kuala Lumpur Regional Centre for Arbitration. The New Zealand Arbitration and Mediation Association, the Hong Kong International Arbitration Center, the Mumbai International Arbitration Center, the Singapore International Arbitration Center, the Korean Commercial Arbitration Institute and the Australian International Arbitration Center supported the event.
At the opening ceremony, former representative of Hague Conference Asia Pacific Regional Office, former International Judge of the Singapore International Commercial Court, former Judge of the High Court of Hong Kong, Professor of the Law School of University of Hong Kong The Honorable Justice Anselmo Reyes made a keynote speech-- "Sovereign Immunity, Crown Immunity, and State–Owned Enterprises; Reflections on Enforcing Arbitral Awards against States”. The symposium focused on topics of "The Judiciary – Has the pendulum swung too far? ", "Arbitral Institutions – Pushing the limits", "Current challenges in the enforcement of international arbitration award and judgments. " and "The Great Debate ". 23 well-known arbitrators, lawyers and experts from Malaysia, Singapore, India, China, Indonesia, Poland, the Netherlands, the United Kingdom and other countries and regions were presented as moderators and speakers. Vice President of the Inter-Pacific Bar Association Francis Xavier, SC and senior officials, as well as the Malaysian Court of Appeals Justice Datuk Harmindar Singh Dhaliwal attended the seminar.
Founding Partner of Jin Mao Partners, Jurisdictional Counsel Member of Inter-Pacific Bar Association, arbitrator of Kuala Lumpur Regional Arbitration Center, Shanghai International Arbitration Center and Shanghai Arbitration Commission Mr. Jack Li was invited to speak at the event on the topic " Recognition and Enforcement of Foreign Arbitration Awards under the Belt and Road Initiative". He also expressed his own thoughts concerning the questions on the first refusal of recognition or enforcement case held by Shanghai' s first Intermediate People 's Court recently.
Li said since more and more Chinese and foreign enterprises have responded positively to the Belt and Road Initiative put forward by Chinese President Xi Jinping and which has been included into the UN legal documents. The recognition and enforcement of foreign arbitral awards in China under this framework has attracted growing concern. The Chinese courts are very cautious holding the refusal of recognition and enforcement of foreign arbitral awards. In order to further develop China's foreign legal services industry and encourage Chinese lawyers to “go-out”, the Chinese government encourages more Chinese lawyers to “go-out” and help to solve international disputes related to investment and financing. Chinese and foreign lawyers will strengthen cooperation by establishing Legal Service Community, and the pursuit of equality and justice will become the common values of Chinese and foreign legal persons and goals. Li's speech was attended with warm applause by more than 120 guests.
It is reported that Mr. Jack Li is the first Chinese lawyer and arbitrator to be invited to give a speech concerning relevant international arbitration legal issues under the Belt and Road Initiative at the international Legal forum held by the major international lawyer organizations and mainstream arbitration institutions. The Asia-Pacific Arbitration Day, which has been held for three consecutive years, has become a branding event focusing on the latest developments in international arbitration in this region.
